Welcome to Dizpathshala (“Company”, “we”, “our”, “us”)! Please read these terms and conditions ("Terms") carefully before accessing or enrolling to the Platform (defined hereinafter). These Terms along with the Privacy Policy published on the Platform ("Privacy Policy") and other policies (as may be notified/displayed/published on the Platform) constitutes the contract between the Users of this Platform and the Company (collectively "Agreement"). By use of the Platform, Users agree to be bound by these Agreement as posted on the Platform from time to time.
These Terms are like any other contract, and they have boring but important legal terms that protect us from the countless things that could happen and that clarify the legal relationship between you and us.
b. Your use of the Platform, services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. c. For the purpose of these Terms of Use, wherever the context so requires "You", "user" and "Learner" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data while registering on the Platform as Registered Learner using the computer systems
d. The Agreement between you and Dizpathshala is effective on the date on which the Learner purchased a bundle and/or the date on which terms of Agreement are updated, creating a legally binding arrangement between you and Us.
b. It is the responsibility of the Learner to check this page periodically for changes. Learner's continued use of or access to our service following the posting of any changes constitutes acceptance of those changes.
a. If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform and refuse to provide You with access to the Platform
b. Transaction on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e. under the age of 18 years, you may use the Platform or access service on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian. As a minor if you wish to transact on the Platform, such transaction on the Platform may be made by your legal guardian or parents. Dizpathshala reserves the right to terminate your membership and / or refuse to provide you with access to the Platform if it is brought to dizpathshala's notice or if it is discovered that You are under the age of 18 years and transacting on the Platform.
c. You agree that Dizpathshala shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update Your mobile phone number and/or e-mail address on the Website Platform.
By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at support@dizpathshala.com.
Dizpathshala is a platform that "you" or "Learner" utilize to meet and interact with one another for our service. Dizpathshala is not and cannot be a party to or control in any manner any transaction between the Platform's Learners.
a. Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.
b. By posting Content on or through Service, You represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.
c. You retain any and all of your rights to any Content you submit, post or display on or through Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through Service. However, by posting Content using Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through Service. You agree that this license includes the right for us to make your Content available to other users of Service, who may also use your Content subject to these Terms.
d. In addition, Content found on or through this Service are the property of Dizpathshala or used with permission. You may not distribute, modify, transmit, download, copy, repost, reuse or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
We issue refunds for the purchases within 3 days of the original purchase of the packages. A payment gateway fee @ 2% of the paid amount and processing fee @5% of the paid amount will be deducted from the amount to be refunded. No Refund will be given to the customer for the purchase of any package made by the customer directly from the Dizpathshala website "www.dizpathshala.com" or through the affiliate link of the person who referred him to the Dizpathshala website after 3 Days of the purchase under any circumstances. For the refund, you need to mail at refunds@dizpathshala.com In the following format with registered e-mail ID only. Full Name - Registered e-mail ID - Registration date - Screen shot of Payment Invoice with date and time (You must have received on e-mail/message when you paid) - Reason for refund - *No refund request will be accepted without above mentioned details. Please note that for the "Refund" you need to mail us only at refunds@dizpathshala.com . The refund request email must be sent within 72 hours of the purchase, if not, the refund cannot be processed After sending the email, it will take 3 working days to process your refund. So please wait for 3 Working days to get the response. Please do not send multiple emails, the system may spam your email address and block. After your Refund is processed, you will get the confirmation in email. It will take another 3 working days after the Refund process to get credit in the Source Bank Account. The refund amount will only be credited in the same Bank Account / Card / Wallet from which you made the payment.
Once you cancel your refund request, this claim will not be reversed in the future.
On cancellation (After 72 hours) you will not be entitled to receive a refund or credit of any fees already paid for any bundle, unless otherwise required by applicable law. For clarity, cancellation of a subscription does not terminate your Udemy account.
You can request for a refund within 72 hours of the purchase of the course.
Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Dizpathshala and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Dizpathshala.
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to refunds@dizpathshala.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims” You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.
You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail): (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest; (ii) a description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work; (iii) identification of the URL or other specific location on Service where the material that you claim is infringing is located; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. (ii) For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise. (iii) To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation. (iv) To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity. (v) In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity. (vi) To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.
(i) Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service. (ii) Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service. (iii) Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent. (iv) Use any device, software, or routine that interferes with the proper working of Service. (v) Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful. (vi) Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service. (vii) Attack Service via a denial-of-service attack or a distributed denial-of-service attack. (viii) Take any action that may damage or falsify Company rating. (ix) Otherwise attempt to interfere with the proper working of Service.
In case of violation of any of these guidelines, the rights to affiliate the Dizpathshala courses could be temporarily suspended or permanently taken away. After suspension or termination, the Affiliate will still be able to access the courses but will not be able to promote the courses and earn commission on their sales.
